Suncoast Aquatic Safety Terms of Service


1. Introduction
These Terms of Service (the 'Terms') govern your use of Suncoast Aquatic Safety LLC’s classes, programs, 
events, and website (collectively, the 'Services'). By registering for or participating in any Services, 
you acknowledge that you have read, understand, and agree to be bound by these Terms. If you do not 
agree, you must not register for or participate in any of our Services.

2. Description of Services
Suncoast Aquatic Safety LLC provides water‑safety education and certification, including but not limited to 
American Red Cross Lifeguarding and Waterfront Lifeguarding courses, Water Safety and Learn‑to‑Swim 
instruction, Basic Life Support (BLS) and CPR/AED courses, first aid training, emergency response classes 
and related programs. The scope and availability of Services may change based on demand, instructor 
availability, weather conditions, venue capacity, and other factors.

3. Eligibility and Participation
Participation is subject to age and prerequisite requirements specific to each course. For example, 
lifeguarding courses typically require a minimum age and completion of an online module and swim 
assessment. By registering, you represent that you (or, for minors, your child) meet all prerequisites, 
are physically and mentally capable of participating safely, and will disclose any medical conditions or 
limitations prior to attendance. Minors must have a parent or natural guardian complete the minor 
participant consent section of our Participant Agreement.

4. Registration and Payment
To reserve a seat in a class, you must complete registration and submit full payment via our approved 
payment processor. Fees are quoted in U.S. dollars and may include mandatory materials or certification 
fees. A booking is not confirmed until payment is received. We reserve the right to decline or cancel 
registrations at our discretion (for example, if prerequisites are not met).

5. Cancellation and Refund Policy
You may cancel your class registration at any time; however, refund eligibility depends on the notice 
provided. A non‑refundable administrative fee of 10 % of the class price applies to all cancellations. 
•  7 or more days before the class: 100 % refund of the course fee, less the 10 % administrative fee.
•  3 to 6 days before the class: 50 % refund, less the 10 % administrative fee.
•  Less than 48 hours before the class: no refund.
No‑shows are not eligible for refunds. Transfers or rescheduling may be offered at the instructor’s 
discretion. Documented emergencies (e.g., sudden illness or car accidents) may be considered for 
transfer to a future class or partial refund.

6. Scheduling and Class Changes
We schedule classes based on demand, instructor availability, weather, and class size. We may reschedule 
or cancel a class for any reason, including but not limited to low enrollment, facility issues, or safety 
concerns. If we cancel or reschedule, we will notify registered participants as soon as possible and 
offer a choice of refund (minus the administrative fee) or transfer to another class date.

7. Assumption of Risk and Waiver
By registering for and participating in our Services, you acknowledge that aquatic and life‑saving 
training involves inherent and non‑inherent risks, including but not limited to slips, falls, muscle 
strains, drowning, exposure to environmental hazards, and contact with equipment or other participants. 
You voluntarily assume all risks associated with participation, whether known or unknown, expected or 
unexpected. Prior to attending, you must sign our Participant Agreement, Assumption of Risk, Release of 
Liability, and Media/Photo Election (the "Waiver"), which is incorporated by reference into these Terms. 
If you do not sign the Waiver, your registration will be cancelled in accordance with our refund policy.

8. Release of Liability and Indemnification
To the fullest extent permitted by law, you release and hold harmless Suncoast Aquatic Safety LLC, its 
owners, instructors, employees, contractors, volunteers, agents, affiliates, host facilities, and 
successors from any and all claims, demands, causes of action, losses, damages, or expenses arising 
out of or related to your participation. You agree to indemnify and hold us harmless from claims 
resulting from your own acts or omissions, your failure to follow instructions or safety rules, any 
damage to property caused by you, and any claims brought on your behalf that are inconsistent with 
these Terms.

9. Medical Consent / Emergency Care
If you are injured or become ill during a class, you authorise our personnel to obtain reasonable 
emergency medical assistance if deemed necessary. You understand that you are financially responsible 
for any medical care, transport, treatment, or related expenses incurred on your behalf. This 
authorisation does not obligate Suncoast Aquatic Safety LLC to provide medical care beyond its training 
or available resources.

10. Code of Conduct and Removal from Activity
Participants must follow all instructor directions, safety rules, and policies. Unsafe conduct, 
harassment, horseplay, suspected impairment, refusal to participate safely, or other behaviour 
creating risk to others may result in immediate removal from the activity without refund, to the extent 
allowed by our refund policy. We may remove you from participation if you become ill, unsafe, or 
disruptive.

11. Equipment and Property
You agree to use equipment only as instructed. You accept responsibility for loss of or damage to your 
personal property while participating, except as otherwise required by law. You accept responsibility 
for loss of or damage to Suncoast Aquatic Safety LLC equipment and property while attending or 
participating, except as otherwise required by law.

12. Media Consent
We may photograph or record participants during training for lawful business purposes, such as marketing, 
social media, website content, educational materials, and promotional content. Your consent or refusal 
is indicated in the Waiver. If you do not authorise us to use your image, voice, or likeness, we will 
honour that choice.

13. Intellectual Property
All content on our website and in our course materials—including text, graphics, logos, images, audio 
clips, and software—is the property of Suncoast Aquatic Safety LLC or its content suppliers and is 
protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create 
derivative works from any content without our express written permission.

14. Governing Law and Venue
These Terms and any disputes arising out of or related to them or your participation in our Services 
shall be governed by the laws of the State of Florida. Any such dispute shall be brought exclusively in 
a court of competent jurisdiction located in the State of Florida, unless otherwise required by law.

15. Severability
If any portion of these Terms is found unenforceable, the remaining provisions shall continue in full 
force and effect to the fullest extent permitted by law.

16. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated Terms on our 
website with a new effective date. Your continued participation in our Services constitutes your 
acceptance of the updated Terms.

This Privacy Policy explains how Suncoast Aquatic Safety LLC ("we", "us", or "our") collects, uses, and 
protects personal information obtained through your registration for and participation in our Services 
and your use of our website. By using our Services or providing personal information to us, you consent 
to the collection and use of information as described in this Policy.

We collect personal information directly from you when you register or participate in our Services. 
This may include your name, address, email, telephone number, date of birth, emergency contact 
information, payment information (processed by our payment provider), course prerequisites and 
evaluation results, signatures on waivers, media consent preferences, and any health or medical 
information you voluntarily provide to facilitate participation. We also collect technical information 
about your device and usage of our website, such as IP address, browser type, device identifiers, 
pages viewed, and cookie data.

4. Sharing Information
We may share your personal information with the following parties: instructors, contractors, 
volunteers, and host facilities who assist in delivering Services; certification bodies such as the 
American Red Cross; payment processors who handle your transactions; emergency responders in case of 
incidents; our professional advisors and insurers; and government authorities when required by law. We 
do not sell your personal information.

5. Media Consent
If you consent in our Waiver, we may use photographs, video, or audio recordings of you from training 
sessions for marketing, social media, educational materials, and other promotional purposes. If you do 
not consent, we will not use your image or likeness.

6. Data Security
We implement reasonable physical, technical, and administrative measures to protect personal 
information against unauthorised access, disclosure, alteration, or destruction. However, no method of 
transmission or storage is completely secure.

7. Data Retention
We retain personal information for as long as necessary to fulfil the purposes for which it was 
collected and to satisfy legal, accounting, or reporting requirements, including documentation of 
certifications and waivers.

8. Your Rights
You may request access to, correction of, or deletion of your personal information by contacting us. 
You may also opt out of receiving marketing communications by following the instructions in our emails 
or contacting us directly.

9. Minors
We collect and process personal information about minors only with the consent of a parent or natural 
guardian. Parents or guardians may request access to, correction of, or deletion of minor participants’ 
information.
